These Terms and Conditions govern purchases made through the Foghorn Designs online store and any organization, team, school, business, fundraiser, or other online store hosted and fulfilled by Foghorn Designs.
By placing an order, you agree to the following terms.
Many products sold through Foghorn Designs are produced specifically for the customer after an order is placed. This includes, but is not limited to, screen-printed apparel, embroidered apparel, decorated merchandise, personalized products, signs, decals, banners, and other custom products.
Because these products are made or decorated specifically for each order, they generally cannot be returned to inventory or resold.
Please review your order carefully before submitting it, including product, color, size, quantity, personalization, shipping information, and other selections.
Apparel sizing can vary significantly between brands, styles, and garment types. A size from one manufacturer may fit differently than the same labeled size from another manufacturer.
When available, product-specific sizing information and measurement charts are provided on the product page. Customers are responsible for reviewing this information and selecting the appropriate size before ordering.
Ordering the wrong size, preferring a different fit, or deciding after receiving the product that another size would be more comfortable is not considered a manufacturing or fulfillment defect.
If Foghorn Designs sends a size different from the size shown on your order, we will make it right.
Due to the custom and made-to-order nature of our products, all sales are final unless the product is defective, damaged, or Foghorn Designs made an error in fulfilling the order.

If we made a mistake, received defective merchandise from a supplier, or produced an item incorrectly, please contact Foghorn Designs within 7 calendar days of receiving your order.
We may request photographs of the product and packaging to evaluate the issue.
If we determine that Foghorn Designs is responsible for the problem, we will, at our discretion, replace the affected product, reproduce the order, issue store credit, or provide a refund.
Please do not return merchandise without contacting Foghorn Designs first.
Products purchased through team, school, organization, company, or fundraiser stores are generally produced after the applicable ordering period closes or according to the production schedule established for that store.
Closing dates, estimated production times, pickup information, and shipping information may vary by store. Once a store closes and production begins, orders generally cannot be changed or canceled.
Foghorn Designs is not responsible for customers who miss an ordering deadline.
Some stores may reopen or offer additional ordering periods, but availability is not guaranteed.
When a store is identified as a fundraiser, a portion of qualifying sales may be paid to or credited to the organization associated with the store.
Fundraising amounts, eligible products, ordering periods, and payment arrangements are established between Foghorn Designs and the organization.
Returns, refunds, canceled transactions, chargebacks, taxes, shipping charges, and other non-qualifying amounts may be excluded from fundraising calculations.
We make reasonable efforts to display product colors and artwork accurately. However, colors displayed on phones, tablets, and computer monitors can vary based on screen settings and device characteristics.
Actual garment, ink, thread, vinyl, substrate, and printed colors may vary slightly from what appears on screen.
Minor color differences are not considered defects.
Product manufacturers may also make changes to garments, materials, construction, dye lots, or other specifications without notice.
Screen printing, embroidery, digital printing, heat-applied graphics, signage production, and other decoration methods involve normal production tolerances.
Slight variations in print placement, embroidery placement, color, dimensions, or appearance may occur from item to item.
These normal production variations are not considered defects.
Products displayed online are subject to availability.
If a selected product, size, or color becomes unavailable before production, Foghorn Designs may contact the customer regarding a comparable substitute, alternate color, alternate size, store credit, or refund for the unavailable item.
We will make reasonable efforts not to materially substitute a product without notifying the customer when the substitution would significantly affect the appearance or nature of the order.
Customers who upload, submit, request, or approve artwork, logos, photographs, trademarks, names, or other content represent that they have the legal right or appropriate permission to use that content.
By submitting content to Foghorn Designs, you authorize us to reproduce and use it as necessary to produce your order.
Foghorn Designs is not responsible for determining ownership of customer-supplied artwork or whether customer-supplied materials infringe upon another person's copyright, trademark, publicity right, or other intellectual property rights.
The customer agrees to be responsible for claims arising from materials they supplied without proper authorization.
Artwork created by Foghorn Designs remains the property of Foghorn Designs unless ownership or transfer of the artwork has been specifically agreed to in writing.
Submission of an order does not guarantee acceptance.
Foghorn Designs reserves the right to refuse or cancel an order when reasonably necessary, including because of product availability, pricing errors, suspected fraud, inappropriate or unlawful content, production limitations, or other circumstances that prevent us from reasonably fulfilling the order.
If we cancel an order that has already been paid and production has not been completed, the applicable amount will be refunded.
Prices are displayed at the time an order is placed and are subject to change without notice for future orders.
Payment is generally required when the order is submitted unless other payment terms have been approved by Foghorn Designs.
Foghorn Designs reserves the right to correct obvious pricing, tax, shipping, or system errors. If an error materially affects an order that has already been submitted, we will contact the customer before proceeding whenever reasonably possible.
Orders enter production at different times depending on the product and store.
If you need to change or cancel an order, contact Foghorn Designs as soon as possible.
We will make reasonable efforts to accommodate the request, but changes and cancellations are not guaranteed once an order has been submitted.
Once merchandise has been ordered specifically for your job, artwork has been personalized, production has begun, or the applicable online store has closed and entered production, the order may no longer be changed or canceled.
Any production or completion date provided by Foghorn Designs is an estimate unless specifically guaranteed in writing.
Production may be affected by product availability, supplier delays, shipping carrier delays, equipment issues, weather, unusually high order volume, or circumstances outside our reasonable control.
We make every reasonable effort to complete orders on schedule but cannot guarantee that every order will be completed by an estimated date.
Customers ordering products for a specific event are encouraged to order well in advance.
Customers are responsible for providing a complete and accurate shipping address.
Foghorn Designs is not responsible for delays caused by incorrect addresses, carrier delays, weather, service interruptions, or other circumstances outside our reasonable control.
Once an order has been transferred to the shipping carrier, delivery schedules are controlled by the carrier.
If a package is lost or damaged in transit, contact Foghorn Designs and we will assist with the carrier claim when appropriate.
Additional shipping charges resulting from an incorrect or incomplete address provided by the customer may be the customer's responsibility.
Some stores may offer pickup at Foghorn Designs, pickup through an organization, or distribution by a team, school, business, or other third party.
Once an order has been transferred to the designated organization or authorized representative for distribution, Foghorn Designs is not responsible for delays in the organization's internal distribution process.
Customers should follow the pickup or distribution instructions provided for their specific store.
Please inspect your order promptly after receiving it.
Claims involving incorrect, defective, damaged, or missing products should be submitted to Foghorn Designs within 7 calendar days of receipt.
Please include your order number, a description of the issue, and photographs when applicable.
Products should not be worn, washed, altered, or otherwise used before reporting a suspected production defect.
Normal wear, improper washing or care, misuse, damage after delivery, or failure to follow applicable care instructions is not considered a manufacturing defect.
To the fullest extent permitted by applicable law, Foghorn Designs will not be liable for indirect, incidental, special, or consequential damages arising from the purchase, use, delay, or inability to use products purchased through our website.
Our liability relating to an individual order will not exceed the amount paid to Foghorn Designs for the product or service giving rise to the claim, except where applicable law requires otherwise.
Nothing in these Terms is intended to limit rights or remedies that cannot legally be limited under applicable law.
You may use this website only for lawful purposes.
You may not attempt to interfere with the operation or security of the website, access accounts or systems without authorization, use automated systems to abuse website functionality, or use the website for fraudulent or unlawful activity.
Foghorn Designs may suspend or terminate access when we reasonably believe the website or an account is being misused.
By placing an order or creating an account, you agree that Foghorn Designs may communicate with you electronically regarding your order, account, store, payment, production status, pickup, shipping, or customer service request.
Marketing communications will be handled separately in accordance with applicable law and your communication preferences.
Foghorn Designs will not be responsible for delays or failure to perform caused by circumstances reasonably beyond our control, including severe weather, natural disasters, power outages, equipment failures, labor disruptions, supplier interruptions, transportation delays, governmental actions, fires, floods, or similar events.
These Terms and Conditions and transactions with Foghorn Designs are governed by the laws of the State of Ohio, without regard to conflict-of-law principles.
To the extent permitted by applicable law, disputes arising from these Terms or a transaction with Foghorn Designs will be handled in the appropriate state or federal court having jurisdiction in or serving Huron County, Ohio.
Foghorn Designs may update these Terms and Conditions periodically.
Changes will become effective when posted to this website. The Terms in effect when an order is placed will generally govern that transaction.
